Arizona Libertarian Party v Arizona State University and Commission on Presidential Debates

    Below is the detailed report of the proceedings in the court case, Arizona Libertarian Party v Arizona State University and Commission on Presidential Debates, that was decided by Maricopa County Superior Court Judge F. Pendleton Gaines III today. The long and the short is that while the judge decided the case on procedural grounds in terms of not granting the injunction, he acknowleged that the case has suffcient merit to proceed to the damages phase. Note that the damages would accrue to the Arizona taxpayers, not to the Arizona Libertarian Party.
Tucson attorney and Libertarian activist David Euchner, who argued the case for the AZLP, received help from Libertarian activists and attorneys from all over the country in the preparation for the case, including Marc Stevens, David Marhoffer, Manny Klausner, Mark Rutherford, Ed Kahn, John Wilde, Liz Andreasen, Craig Stritar and Michael Kielsky to name only a few. Many more across the country contributed time in serving process, researching case law, and much more. There is much more to be said, but the case is not yet over, so more will have to wait until later.
The AZLP will pursue the case for the $2.5M that ASU has committed to the event and hopes to see those funds returned to the taxpayers rather than be a state funded contribution to two already well funded private campaigns. Though our opposition to taxes is well known, if they are to be collected they should go to the single working mothers, underfunded law enforcement agencies and the schools of Arizona, not to private political campaigns which already have their own fundraising machines.

Libertarian Write-in & Listed Candidates for the Primary Election

    Several Libertarian candidates REALLY REALLY NEED YOU to write in their names in the primary election.
Depending on the district and office, a certain number of write-in votes are NECESSARY for the candidate to get into the ballot for the general election in November. If these candidates won't get onto the ballot they don't get the chance to spread the Libertarian message through the media. PLEASE, PLEASE use your absentee ballot or go to your polling place on September 7 and write in these Libertarian candidates.

Gun Show Registration Drive
    The Maricopa County Libertarian Party was able to secure a voter registration table at Phoenix's Crossroads of the West Gun Show. This is the largest gun show in Arizona with 15,000+ attendees.
While we have rented tables at previous shows, this was our first complimentary table. Better yet, we were located right at the main entrance next to the GOA and NRA.

Yavapai Libertarians Gain County Ballot Status
    "Prescott, Arizona - County Recorder Patsy Jenney-Colón recently verified that the Yavapai County Libertarian Party has gained ballot access following a major petition drive.
This will allow Libertarian candidates on the election ballot for partisan Yavapai County offices in the 2004 primary and general elections. Over one thousand Yavapai County voters signed the petition.

"Clean Elections" enforcers target LP candidates
    "A trio of defeated Phoenix-area legislative candidates spent thousands of dollars on alcohol, food, rental cars and entertainment expenses at trendy Scottsdale nightspots -- and used Clean Elections money to do it. The three District 17 Libertarian candidates -- Yuri Downing, 32; Trevor Clevenger, 32; and Paul DeDonati, 30, who ran as a team -- were ordered by the Citizens Clean Elections Commission to repay $104,237 in state campaign cash. The Libertarian candidates are appealing the commission ruling ... Downing said the trio will likely file a lawsuit against the commission, which he charges is trying to limit political speech."

Voting machine fails inspection
    "University researchers delivered a serious blow to the current crop of electronic voting systems in an analysis of one such system's source code in which they concluded that a voter could cast unlimited ballots without detection. Using an earlier version of the source code that powers machines manufactured by Diebold Election Systems, the security experts -- three from Johns Hopkins University and a colleague from Rice University -- performed an audit and found numerous security holes."
